DIGITAL WALLET TERMS AND CONDITIONS FOR OJSC “AFB BANK” CUSTOMERS

 These terms and conditions govern your use of the Digital Wallet service ("Service") for making payments using your payment card ("Payment Card") issued by OJSC “AFB Bank ”( “Bank”). By accessing or using the Service, you agree to be bound by these terms and conditions. If you do not agree to these terms and conditions, you may not use the Service.

 

DISCLAIMER OF WARRANTIES:

The Digital wallet service is a service offered by your Digital Wallet provider using devices deemed eligible by your Digital Wallet provider. The Bank makes no representations or warranties of any kind, express or implied, as to the operation of the Service or the information, content, materials, or products included on the Service. We likewise are not responsible for any information or other services provided to you by Digital wallet provider or any other third parties associated with the Digital wallet service. We are not liable for any failure or performance of the Digital wallet service.

You agree that the use of any Payment Card in Digital wallet is at your sole risk. You understand that your use of the Digital wallet service will also be subject to agreements or terms of use Digital wallet or other parties.

 

RELATIONSHIPS TO OTHER AGREEMENTS:

Your use of the Service does not impact any other agreement the Bank has with you. The terms of use for your Payment Card which were provided to you at account opening and amended from time to time remain in full force and effect regardless of whether or not you use the Digital wallet service. Any transaction you make with your enrolled Payment Card using the Digital wallet service will be considered the same as if you had used it in person to conduct the transaction and all applicable fees and interest will apply per the terms of your cardholder agreement with us.

 

ELIGIBILITY:

To be eligible to use the Service, your Payment Card and the underlying account must be in good standing and you must not be restricted from using Digital wallet based upon any limitations, your wireless service provider, and / or any third party associated with Digital wallet.

 

DEVICE ELIGIBILITY:

You need to have an eligible device in order to use this service. The Bank is not responsible for any damages resulting from the use of the Service on ineligible devices.

 

FEES:

Bank does not currently charge a fee for the use of your Payment Card in Digital wallet services. However, Wallet provider or another third party supporting Digital wallet may contemplate fees, limitations and restrictions which might affect your use of a Card (such as data usage or text messaging charges imposed on you by your wireless carrier). You agree to be solely responsible for all such fees and agree to comply with such limitations and restrictions.

 

SUSPENSION OF PAYMENT CARD:

The Bank reserves the right to suspend or cancel your Payment Card at any time. Bank may take these actions at any time and for any reason, such as if we suspect fraud with your Payment Card, your Device becomes lost or stolen, or if applicable laws change.

 

INDEMNITY:

You agree to indemnify and hold the Bank, its affiliates, and their respective officers, directors, agents, and employees, harmless from and against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, arising or resulting from your use of the Service or your breach of these terms and conditions.

 

TERMINATION OR CHANGE:

The Bank reserves the right to terminate or change this Service or access to your Card for Digital wallet, or to terminate, add, delete or change any term or condition of the Bank Terms and Conditions for Digital wallet. We will provide you with notice of any such termination or change as required by law. Your acceptance and agreement needed to any change in the Terms and Conditions for further use of the Service.

 

YOUR RESPONSIBILITIES:

If you want to add a Payment Card to the Wallet, you agree to follow the procedures adopted by your Digital wallet and any further procedures we adopt. We may not add a Payment Card to the Wallet if we cannot authenticate the Payment Card or if we otherwise suspect that there may be fraud associated with the Payment Card. You are also responsible for all transactions made using your Payment Card, whether or not you authorized them.

 

SECURITY:

The Bank uses reasonable security measures to protect the Service and your Payment Card information. You are solely responsible for maintaining the confidentiality of your Digital wallet ID, passwords, device passwords and any other means that you may use to securely access Digital wallet on your device. You agree to safeguard your device at all times.

 

PRIVACY:

The Bank respects your privacy and is committed to protecting your personal information. The Bank's privacy policy, which is available on the Bank's website, explains how the Bank collects, uses, and protects your personal information.

 

COMMUNICATION:

By using the Service, you consent to receive electronic communications from the Bank, such as emails, texts, and push notifications, regarding the Service and your account. You agree that any notice, agreement, disclosure, or other communication that the Bank sends to you electronically will satisfy any legal communication requirements.
